Terms of Service

1. Acceptance of Terms

By accessing or using the AIGlasses mobile application ("App"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the App.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App following any changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.

2. Description of Service

AIGlasses is an iOS application designed to enable live streaming from Ray-Ban Meta glasses and iPhone cameras to various streaming platforms including, but not limited to, YouTube Live, Facebook Live, Twitch, and Instagram Live. The App provides features including:

• Real-time video and audio streaming
• Multi-platform streaming capabilities
• Optional AI-powered features including face recognition overlays
• Optional Gemini AI integration for voice interactions
• Photo capture during streaming sessions
• Video file streaming functionality

3. Eligibility and Accounts

3.1 Age Requirements

You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 Accurate Information

You agree to provide accurate, current, and complete information when creating accounts or connecting to third-party services through the App. You are responsible for updating this information to keep it accurate.

4. Streaming Platform Integration

4.1 Third-Platform Terms

The App enables streaming to third-party platforms including YouTube, Facebook, Twitch, and Instagram. By using these features, you agree to comply with the terms of service and community guidelines of each respective platform. You are solely responsible for ensuring your content complies with these third-party terms.

4.2 Content Responsibility

You are solely responsible for all content streamed through the App. This includes ensuring you have all necessary rights, permissions, and consents to broadcast the content, including consent from individuals who appear in your streams.

4.3 Platform Policies

You acknowledge that streaming platforms may:

• Suspend or terminate your account for violations of their terms
• Remove content that violates their community guidelines
• Change their terms of service or API access at any time
• Limit or restrict streaming functionality

We are not responsible for any actions taken by third-party streaming platforms against your accounts.

5. User Conduct and Content

5.1 Prohibited Activities

You agree not to use the App for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to:

• Stream content that infringes on intellectual property rights
• Broadcast illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Stream content that violates the privacy rights of others without consent
• Use the App to harass, stalk, or harm other individuals
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the integrity or performance of the App
• Use the App for any commercial purpose without our express written consent
• Reverse engineer, decompile, or disassemble any aspect of the App

5.2 Consent Requirements

You are responsible for obtaining consent from all individuals who appear in your streams, particularly when using face recognition features. Recording or streaming individuals without their knowledge and consent may violate privacy laws in your jurisdiction.

6. AI and Face Recognition Features

6.1 Optional AI Features

The App offers optional AI-powered features including Gemini Live integration and face recognition overlays. These features require explicit activation and configuration by you.

6.2 Gemini AI Integration

When you enable Gemini Live integration:

• Video frames and audio may be sent to Google's Gemini API for processing
• Your use is subject to Google's Terms of Service and Privacy Policy
• We are not responsible for AI-generated responses or their accuracy
• You should not rely on AI responses for critical or emergency situations

6.3 Face Recognition

The face recognition feature uses DeepFace technology. You acknowledge that:

• Face recognition accuracy may vary and is not guaranteed
• You are responsible for enrolling individuals and obtaining their consent
• Face recognition data is processed locally or through your configured overlay service
• We do not store facial recognition data on our servers

7. Intellectual Property

7.1 Our Intellectual Property

The App, including its original content, features, functionality, and design, is owned by AIGlasses and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, create derivative works from, distribute, sell, or lease any part of the App without our express written permission.

7.2 Your Content

You retain all rights to the content you stream through the App. By using the App, you grant us a limited, non-exclusive, royalty-free license to use your content solely for the purpose of providing and improving the App's services.

7.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without any obligation to compensate you. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate such feedback into the App.

8. Third-Party Services

The App integrates with various third-party services including:

• Meta Wearables Device Access Toolkit (DAT) for Ray-Ban Meta glasses connectivity
• YouTube, Facebook, Twitch, and Instagram APIs for streaming
• Google Gemini API for AI features (when enabled)
• Apple App Store for distribution and in-app purchases

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, content, or policies of these third-party services. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party.

9. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the collection and use of information as described in our Privacy Policy.

9.1 Data Security

We implement reasonable security measures to protect your information. However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.

9.2 International Data Transfer

Your information may be transferred to and processed in countries other than your own. By using the App, you consent to such transfers and processing.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AIGlasses, its developers, contributors, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the App
• Any content obtained from the App or through streaming platforms
• Unauthorized access, use, or alteration of your transmissions or content
• Statements or conduct of any third party on or through the App
• Any AI-generated content or face recognition errors
• Actions taken by streaming platforms against your accounts

In no event shall our total liability to you for all claims exceed the amount you paid us, if any, for using the App during the twelve (12) months immediately preceding the claim.

11. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that:

• The App will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements
• Streaming to third-party platforms will always be successful
• AI features will produce accurate or appropriate responses

12. Termination

12.1 Termination by You

You may terminate your use of the App at any time by deleting the App from your device and revoking any OAuth permissions granted to the App through your streaming platform accounts.

12.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

12.3 Survival

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

You agree that any legal action or proceeding between you and us shall be brought exclusively in the federal or state courts located in California.
